Children's Court Intervention in Victoria

Children's Court intervention is necessary when a protective worker decides that parents or caregivers cannot care for a child safely. The child is placed on a Protection Application and a magistrate of the Family Division of the Children's Court is required to make a decision about the child's circumstances.

The Family Division of the Children's Court is responsible for hearing child protection matters. The Criminal Division deals with matters relating to criminal charges against children. Proceedings in the Family Division are less formal than other courts.
