Regulatory Impact Statement

Introduction

The Disability Regulations 2007 was approved by Governor in Council on 26 June 2007 with the same effective date of 1 July 2007 as the Disability Act 2006. The new regulations ensure transparency and accountability of residents’ funds and residential charges, safeguard the rights of people with a disability residing in residential services and protect the rights of people subject to restrictive interventions and supervised treatment. Introduction of new regulations is subject to the Subordinate Legislation Act 1997. The Scrutiny of Acts and Regulations Committee (SARC) requires a regulatory impact statement to be prepared for public consultation to justify any new regulations which impose an appreciable economic or social burden on a sector of the public.

Four submissions from the public consultation on the Regulatory Impact Statement were considered.

Regulatory Impact Statement

Government has a responsibility to regulate the provision of services to safeguard the rights of vulnerable individuals. The proposed Disability Regulations 2007 provides details on areas of the Disability Act 2006 where Government considers people with a disability receiving disability supports require particular safeguards that are best protected by regulation rather than other mechanisms.

A Regulatory Impact Statement (RIS) is required for any regulation (statutory rule) that imposes an 'appreciable burden'.

Public consultation on the RIS is an integral part of the regulation-making process in Victoria. This document has been prepared in accordance with the Victorian Guide to Regulation that emphasises Government regulation should not unduly impact on business productivity and growth whilst at the same time support achievement of Government strategic policy objectives and respond to community needs. The objectives of the proposed regulations are to prescribe:

Part A provides information regarding the rationale and impact of proposed Regulations that are considered to have negligible “appreciable economic or social burden on a sector of the public”.

Part B is the Regulatory Impact Statement associated with proposed regulation Section 11. The proposed regulation under Section 11 sets out fees payable for the accommodation and care of, and services provided to, people with a disability who reside in residential institutions operated by the Department of Human Services (DHS). Public submissions in response to this Regulatory Impact Statement are invited from all interested parties.
