6.2 Statutory Immunity
70 public acute hospitals have statutory immunity in line with Section 139 of the Health Services Act 1988. This represents 75 per cent of all public acute hospitals.
A review of statutory immunity will be undertaken during 1997-98 to:
- Evaluate the use of statutory immunity.
- Identify how statutory immunity processes can be used more effectively to enhance health care.
- Identify strategies to make statutory immunity more useful and attractive to providers as part of their quality assurance processes.
Agencies that do not have third party accreditation/certification or have not been declared under statutory immunity provisions of section 139 of the Health Services Act are required to have a quality assurance plan available to the Department on request.
