2.9 Force Majeure


Circumstances (including industrial action), beyond the reasonable control of hospital management, may sometimes prevent the attainment of targeted throughput. In previous years, in these circumstances, the Department has, on a case by case basis, reimbursed hospitals for throughput not undertaken. Hospitals are expected to mitigate their loss in such events and any future claims will be considered on a commercially prudent 'loss of net revenue' basis.
