New child safe standards enshrined into law

07 December 2015

The Victorian Parliament has passed legislation which aims to improve the way organisations prevent and respond to child abuse in Victoria.

The child safe standards (the standards) aim to drive cultural change in organisations that provide services for children so that protecting children from abuse is embedded in everyday thinking and practice. A full list of the types of organisations in scope for the standards can be found on this site.

The Victorian Government will work with organisations to help organisations implement the standards and provide safe environments for children.

The standards will be implemented in two phases:

  1. From 1 January 2016: the standards will apply to Victorian Government departments providing services for children, including DHHS, and service providers funded, contracted or regulated by the Victorian Government including by DHHS. Organisations in this first phase will be required to work towards compliance from 1 January 2016.
  2. From 1 January 2017: The standards will apply to organisations that have limited or no funding or regulatory relationship with government from 1 January 2017.

Wherever possible the child safe standards will be integrated within existing regulatory, funding and contractual government requirements.

The standards are part of the Victorian Government’s response to Betrayal of Trust, the report of the Inquiry into the Handling of Child Abuse by Religious and other Non-Government Organisations.

Further information about the standards can be found on the DHHS website. including:

  • the child safe standards
  • a full list of the types of organisations in scope for the standards
  • An Overview to the Victorian child safe standards, which includes general guidance, examples of how organisations could implement each of standards and a self-audit tool
  • further online tools and templates, including sample codes of conduct, child safe policies and risk management tools will be available in the coming weeks.
